PRIVACY POLICY


Plastic 77 with registered office in Contrada Sant'Agostino - 62019 Recanati (MC) - ITALY (hereinafter "Plastic 77") is committed to protecting the personal data of its users in accordance with the GDPR 2016/679 Regulation. This document will allow you to understand our policy on the protection of personal data and how your personal information is managed when you use our services. If necessary, it will allow you to provide an express and informed consent to the processing of your personal data in the sections of the website where you are asked to provide personal data. Please note that in various sections of the plastic77.com website (hereinafter "Site") where we collect your personal data, specific information is provided in accordance with article 13 of EU Regulation 2016/679 and must be read before providing the requested data. The information and data provided by you or otherwise acquired in the context of registration for various Plastic 77 services will be processed in accordance with the provisions of the Regulation and the confidentiality obligations that inspire Plastic 77's activities. According to the Regulation, the processing carried out by Plastic 77 will be based on the principles of lawfulness, fairness, transparency, limitation of purposes and storage, minimization of data, accuracy, integrity and confidentiality.

1- Purpose of the processing
The processing that we intend to carry out, with your specific consent where necessary, has the following purposes: a. To allow the provision of services requested by you and subsequent operational, technical and administrative management of the relationship connected to the provision of services and the sending of communications related to the performance of the established relationship; b. To allow browsing and consultation of Plastic 77 websites; c. To respond to requests for assistance or information that we receive via email, telephone or through appropriate forms; d. To comply with legal, accounting and tax obligations; e. To send direct commercial offers via email for services authorized by you through explicit prior consent; f. To conduct studies, market research and statistics; to send advertising material, informative material, commercial information or surveys to improve service ("customer satisfaction") via email or via SMS, and/or through the use of telephone operators and/or through official pages of the Website and on social networks through explicit prior consent; g. To make personalized commercial proposals based on services purchased by you, or that you have shown interest in by browsing our Website. This means, for example, that if you have browsed our Website to search for information on certain products, you may receive offers related to those offers. This type of analysis is typically carried out on purchase data relating to both natural persons and legal persons, and the related decisions are not based solely on automated processing.  

2- Legal basis and mandatory or optional nature of the processing
The legal basis for the processing of Personal Data for the purposes set out in section 1(a)(b)(c) is article 6.1.b of the GDPR Regulation, as the processing is necessary for the performance of the contracted services. The provision of Personal Data for these purposes is optional, but failure to provide them would make it impossible to activate the requested Services. The purpose set out in section 1(d) represents a legitimate processing of Personal Data under article 6.1.c of the Regulation. Once Personal Data has been provided, processing may indeed be necessary to comply with legal obligations to which Plastic 77 is subject. The processing carried out for marketing purposes described in sections 1(e)(f) is based on your consent under article 6.1.a of the Regulation. The provision of your Personal Data for these purposes is entirely optional and does not affect the use of the Services. The processing described in section 1(g), carried out for the purpose of email marketing on products or services similar to those purchased by you, finds its legal basis under article 6.1.f of the Regulation, in the legitimate interest of Plastic 77 to promote its products or services in a context in which the data subject can reasonably expect such processing, to which they can object at any time. If you wish to object to the processing of your data for the purposes of marketing, set out in sections 1(e)(f)(g), you can do so at any time via the mechanism proposed in the footer of commercial emails or by sending an email to privacy@plastic77.com.

3- Data Controller and Data Protection Officer (DPO)
The Data Controller of the processing activities is Plastic 77 as defined above. The DPO is available for any information regarding the processing of personal data of Plastic 77, including the list of processors who handle data. You can contact the DPO by writing to: privacy@plastic77.com


4- Personal Data Subject to Processing
For the processing of personal data, any operation or set of operations, performed with or without the use of automated processes and applied to personal data or sets of personal data, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, communication by transmission, dissemination or any other form of making available, comparison or interconnection, limitation, erasure or destruction, is meant. We inform you that the personal data subject to processing will consist - also depending on your decisions on how to use our services - of an identifier such as name, email address, an identification number, location data, an online identifier, purchases made, and other data suitable for identifying or making you identifiable, depending on the type of service requested (hereinafter only "Personal Data"). In particular, the Personal Data processed through the Site are as follows:  

a. Browsing data
The computer systems and software procedures used to operate the Site acquire, during their normal operation, some Personal Data whose transmission is implicit in the use of Internet communication protocols. This information is not collected to be associated with identified individuals, but by its very nature, it could, through processing and association with data held by third parties, allow users to be identified. This category of data includes IP addresses or domain names of computers used by users who connect to the Site, URI (Uniform Resource Identifier) addresses of the resources requested, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.), and other parameters related to the operating system and the user's computer environment. This data is used for the sole purpose of obtaining anonymous statistical information on the use of the Site and our clients' sites and to monitor their correct functioning, to identify anomalies and/or abuses, and is immediately deleted after processing. The data may be used to ascertain liability in case of hypothetical computer crimes against the Site or third parties.  

b. Data voluntarily provided by the data subject
In using particular services (such as registration for newsletters), the processing of Personal Data of third parties that you have sent to the Service provider may occur. In relation to such cases, you act as an independent data controller, assuming all the legal obligations and responsibilities. In this sense, you grant the widest possible indemnity to Plastic 77 with respect to any dispute, claim, request for compensation for damage from processing, etc. that may be received by Plastic 77 from third parties whose Personal Data has been processed through your use of the services in violation of the applicable personal data protection regulations. In any case, if you provide or otherwise process Personal Data of third parties in using the service, you guarantee from now on - taking all related responsibility - that such particular processing hypothesis is based on an appropriate legal basis (such as the data subject's consent) under Article 6 of the Regulation that legitimizes the processing of the information in question.

5- Cookies
The "Site" (plastic77.com) uses Cookies to make its services simple and efficient for users who view the pages of plastic77.com. Users who access the Site will have small amounts of information inserted into their devices, whether they are computers or mobile devices, in small text files called "cookies" saved in the directories used by the User's web browser. Cookies are small text files that websites visited by the user send and record on their computer or mobile device, to be transmitted back to the same sites on the next visit. 6- Recipients of Personal Data
Your Personal Data may be shared, for the purposes outlined in section 1 above, with: a. subjects who typically act as data processors, namely: i) individuals, companies, or professional firms who provide assistance and consulting services to Plastic 77 in accounting, administrative, legal, tax, financial, and credit recovery matters relating to the provision of Services; ii) subjects delegated to perform technical maintenance activities (including maintenance of network devices and electronic communication networks); b. subjects, entities, or authorities to whom it is mandatory to communicate your personal data pursuant to legal provisions or orders from authorities (for example, in the course of criminal investigations, Plastic 77 may receive requests from the judicial authority to provide telematic traffic logs); c. individuals authorized by Plastic 77 to process Personal Data necessary to perform activities strictly related to the provision of Services, who have committed to confidentiality or have an adequate legal obligation of confidentiality, such as employees and collaborators of Plastic 77. 7- Transfer of Personal Data
Plastic 77 does not share any Personal Data with recipients located outside the European Economic Area.

8- Data Retention Period
Data that is mandatory for contractual and accounting purposes is retained for the time necessary to carry out the commercial and accounting relationship. In any case, since these are processing activities carried out for the provision of Services, Plastic 77 will process Personal Data until the time allowed by Italian law to protect its interests. For the purposes outlined in sections 3(e), (f), and (g), your Personal Data will instead be processed until you revoke your consent. Plastic 77 may, in any case, keep your Personal Data until the time allowed by Italian law to protect its interests (Art. 2947(1)(3) c.c.). More information about the data retention period and the criteria used to determine it can be requested by writing to the DPO.

9- Rights of the data subject
Under European Regulation 679/2016 (GDPR) and national legislation, the data subject may, in accordance with the procedures and limits provided by current legislation, exercise the following rights:
− to request confirmation of the existence of personal data concerning them (right of access);
− to know their origin;
− to receive intelligible communication;
− to have information about the logic, methods and purposes of the processing;
− to request updating, rectification, integration, erasure, anonymization, or blocking of data processed unlawfully, including data that is no longer necessary for the purposes for which it was collected;
− in cases of processing based on consent, to receive their data provided to the controller in a structured, commonly used and machine-readable format, and to transmit that data to another controller without hindrance;
− the right to lodge a complaint with the supervisory authority. To exercise their rights, the data subject can write to privacy@plastic77.com.

10- Changes
This privacy policy has been in effect since March 1, 2023. Plastic 77 reserves the right to modify or simply update its content, in whole or in part, also due to changes in applicable legislation. If the changes to this policy concern substantial changes to the processing or may otherwise have a significant impact on data subjects, Plastic 77 will take appropriate steps to notify them.
